Rental contract

Here is a sample of our rental contract. As a legal contract it contains all you might expect but our cabin is a big investment and we need to protect it as best we can. Hardly any of the clauses have been applied literally and our objective is to allow you as much freedom as possible. So you want to come back.

VACATION CABIN RENTAL AGREEMENT

This agreement between Roger Hughes, (herein called the owner) of premises located at 474 Yellow Daisy Lane, Valle Crucis, North Carolina (herein called the cabin), And:

Write below the names of everyone in the party: (including ages if under 18). The principal agrees the cabin will not be used or occupied by more than the persons set forth herein. Principal shall not assign this agreement or sub let the cabin in whole or in part.

2.       The owner agrees to rent the cabin to the principal on a short-term basis only, for the dates set herein, in consideration of payment as the above. It is understood by both parties that this agreement is only for the dates set herein. The principal and his party shall not occupy the cabin either before or after these dates. In the event that principal or party are found to occupy the cabin either before or after the agreed dates the owner shall have the right to charge twice the daily rate on a pro-rata basis for every day overstay, and commence eviction proceedings. The owner may however grant an extension of the dates upon request and subject to availability.

Arrival should not be before 3pm, and departure should be after 11am, except by arrangement with the cabin manager.

5.       This emailed agreement shall be the original agreement, no further agreement will be mailed. Principal should print this document, complete and sign. Payment should be made by personal check  & mailed to the cabin manager. Half the gross amount is required to reserve the booking, with the remainder due 30 days prior to occupancy. If the reservation is within 30 days the total rental fee is required to confirm the booking. A $30.00 charge will be made for each returned check.

6.       No refund will be given for inclement weather, however, in the event of a mandatory evacuation by the local authorities a pro-rata share of the rental will be refunded. The principal is advised that access to the cabin is partially by dirt road. Under icy conditions it is advisable to use four wheel drive vehicles. No responsibility will be accepted for damage to vehicles or occupants driving to the cabin.

7.      In the event of the principal canceling, refunds will only be given if the cabin can be rented to another party for the same dates. In this case, if the cancellation is prior to 30 days of the rental date a refund will be given, less a 20% cancellation fee. If cancellation is after 30 days a refund will be entirely at the owners discretion.

8.      Security deposits may be deducted for damage and the Principal and his party shall be liable for any charges for damage or loss not specifically described in this agreement. Security deposit which will be returned not later than 30 days after departure.

9.       The principal and all members of his party agree to indemnify and hold harmless the owner and his manager against all liability for personal injury or personal property damage sustained by anyone whilst in the cabin or anywhere on the property. This clause shall also include any guests invited to the cabin by the principal or his party. This clause particularly applies to the hot tub, where precautions are posted and care should be exercised, particularly with children. 

10.   It is agreed that the owner or his manager may enter the cabin during all reasonable hours, to make repairs, improvements or alterations as the owner may deem appropriate.  

11.   If a lockout occurs or the door key is lost, call the manager (828) 266-9008, and arrangements will be made. A charge may be made at the manager’s discretion. 

12.   The owner endeavors to keep all equipment in good working order. If anything is found not in working order, please notify the manager immediately at 828- 265-4102, and owner will correct as soon as possible. However, no rebates will be given due to malfunctioning or breakdown of appliances, television VCR/DVD, telephones or any other equipment or services. 

13.   No campfires, campers, ATV's or tents shall be kept on the property. 

14.   Pets must be pre-approved. The pet fee is non-refundable, it is not a deposit. 

15.   SMOKING IS NOT PERMITTED IN THE CABIN. If any tobacco products or tobacco smell is found in the cabin an extra cleaning fee will be deducted from the deposit. Smokers should be very careful when smoking anywhere outside the cabin and environs, due to the danger of fire. 

16.   Rowdy parties are prohibited. Any complaints filed with the County sheriffs department will result in immediate eviction. 

17.   Bed and bath linens are provided. All beds have pillows and blankets. Additional linens & blankets are available for the futon beds. 

18.   Principal is responsible to dispose of all garbage and other waste. Garbage should be removed and taken to the County drop on Highway 105. There is no charge to deposit garbage at the County site. 

19.   The cabin will be inspected prior to and after departure. Please report damage to the manager immediately 828-266-9008. It may be possible to effect repair and thereby alleviate any questions afterwards. 

20.  If it is discovered the owner's closet has been forced, a charge will be made for full replacement of all items missing, plus expense of repair to the door. 

21.  The principal is responsible for leaving the cabin in neat order. Please make sure all books, games, toys, videos, etc. are returned to their place. Clean all food out of the refrigerator and cabinets and wash and put away dishes, If the BBQ has been used it should be cleaned with the stove cleaner and brush provided. lock all doors and windows and place the key back in the lock-box. $25.0 will be deducted from the security deposit for keys not returned to the lockbox. 

This contract is bound upon receipt and deposit of the renters' first payment.
